Terms of Service
Effective date: to be set at publication.
1. Agreement
These terms govern use of the TruancyTracker service. By using the service, the customer School or district ("Customer") agrees to them. Where a signed agreement or DPA exists, that agreement controls.
2. The service
TruancyTracker syncs attendance from the Customer's student information system, tiers students by the Customer's configured thresholds, sends family notifications on the Customer's behalf, and produces reports.
3. Accounts & access
The Customer is responsible for its user accounts, for keeping credentials confidential, and for the activity of its users. Accounts are for authorized school personnel only.
4. Acceptable use
The Customer will use the service only for its legitimate educational purpose and in compliance with applicable law, and will not attempt to access other tenants' data, disrupt the service, or reverse-engineer it.
5. Customer data & privacy
The Customer owns its data. We process it per our Privacy Policy and the DPA. Student data is handled under FERPA and applicable state laws. On termination we provide an export and delete the data.
6. Fees
The service is provided on a per-school subscription. Fees, term, and payment method (card or purchase order/invoice) are set out in the order form.
7. Warranties & disclaimers
We provide the service with reasonable care and the security practices described on our Security page. Except as expressly stated or required by law, the service is provided "as is" without other warranties.
8. Limitation of liability
To the extent permitted by law, neither party is liable for indirect or consequential damages; specific limitations are set out in the signed agreement.
9. Term & termination
Either party may terminate as provided in the order form. On termination, access ends and Customer data is returned and deleted per the DPA and our Privacy Policy.
10. Governing law
Governing law and venue are as stated in the signed agreement.
